Conclusion of Memorandum of Cooperation on Industrial Property between the Japan Patent Office and the National Office of Intellectual Property of Vietnam
On February 13, the Japan Patent Office (JPO) and the National Office of Intellectual Property of Vietnam (NOIP）concluded a Memorandum of Cooperation (MOC) to develop an effective Industrial Property (IP) system in Vietnam.
With this MOC concluded, the cooperation activities in the area of IP between Japan and Vietnam will be further enhanced. As the IP infrastructure in Vietnam increasingly improves, it is expected that the IP rights owned by Japanese companies will be increasingly protected in Vietnam.
Vietnam has realized a high economic growth of 7% on average in the past five years. According to Vietnam's ten-year plan called "Socio-economic Development Strategy", announced last year, the government aims at reforming Vietnam to be a modern industrialized country by 2020. In addition, the number of patent applications in Vietnam has increased since 2003 by 18% on average per year, which is higher than the GDP growth rate. It is expected that the importance of IP will rapidly increase in the future in Vietnam where the economy is growing rapidly. On the other hand, Japanese entrepreneurs are actively pursuing direct investment in Vietnam. Many companies have advanced into Vietnam and IP management in Vietnam will also be increasingly important for Japan.
Further, ASEAN member states are aiming at establishing a community for free economic activities within its region in 2015 and focusing on enhancement of IP protection for realizing the goal. At the First Japan-ASEAN Heads of Intellectual Property Offices Meeting held on February 8, it was confirmed that enhancement of IP rights protection would be necessary for economic growth of ASEAN in the future and that Japan would cooperate in this endeavor, and Tokyo IP Statement* was adopted at that time.
2. Memorandum of cooperation on industrial property with NOIP
On February 13, the JPO and the NOIP confirmed that promotion of cooperation in the field of IP would be important to improve economy, trade, science, and technology between Japan and Vietnam. They concluded a MOC to develop an effective IP system in Vietnam.
The MOC contains comprehensive cooperation details including consultation on policies toward protecting IP rights in Vietnam, streamlined examination process, strengthening automation of the IP administration system, as well as support of public awareness and human resources development in relation to IP rights.
After the conclusion of the MOC, it is expected that cooperation activities on IP between Japan and Vietnam will be further enhanced, that the infrastructure for IP protection in Vietnam will be further improved and that IP rights of Japanese companies will be properly protected and exploited.
The JPO will continuously strengthen cooperation with emerging countries including ASEAN member states in the field of IP and will make efforts in supporting global activities of Japanese enterprises.
