Addition and Removal of Taliban-Associated Entities, Terrorists and Others Subject to Asset-Freezing Measures

The Government of Japan has been implementing measures to freeze assets of Taliban-associated entities and other terrorists designated by the United Nations Security Council Sanctions Committee pursuant to United Nations Security Council Resolutions ("UN Resolutions") 1267, 1333, 1390, 1988 and 1989. Following the Sanctions Committee's addition of one individual to and removal of six individuals from the asset-freezing list, the government has decided to revise such entities subject to the asset-freezing measures in Japan.

Pursuant to UN Resolution 1373, the government has been implementing asset-freezing measures against terrorists and others, and the government has also decided today to lift the measures against one individual since the Cabinet approved the "Asset-Freezing Measures against Terrorists and Others," in which the measures against the individual were lifted.

1. Details of the measures

  1. On May 30, 2012, the government of Japan will impose the following measures under the Foreign Exchange and Foreign Trade Act (hereinafter called the "Act") on one individual who will be newly added to the list of Taliban-associated entities by public notice 192 of the Ministry of Foreign Affairs (MOFA) that will be promulgated on the same day.
    • [i] Payment restrictions
      Payment to those designated by the above MOFA public notice shall require prior permission.
    • [ii] Capital transaction restrictions
      Capital transactions with those designated by the above MOFA public notice shall require prior permission.
  2. On May 30, 2012, Japan will lift the payment restrictions and capital transaction restrictions imposed under the Act on the Taliban-associated entities to be removed from the asset-freezing list by MOFA public notice 192 that will be promulgated on the same day.
  3. On May 30, 2012, Japan will lift the payment restrictions and capital transaction restrictions imposed under the Act on the terrorists and others removed from the asset-freezing list by MOFA public notice 191 that will be promulgated on the same day.

2. Entities subject to the measures

Note: As a result of the above addition and removal, the total number of Taliban-associated entities and other terrorists that are subject to sanctions by the government of Japan has come to 390 individuals and 92 groups.
