The Government of Japan Applied to Join the APEC Cross-Border Privacy Rules System

On June 7, 2013, the Government of Japan applied to participate in the APEC Cross-Border Privacy Rules (CBPR) System, a framework under which measures to protect cross-border private information of enterprises and other entities are certified if such measures are compatible with the APEC Information Privacy Principles.

1. Background and outline of the system

APEC established the APEC Information Privacy Principles in 2004, and has since been recommending that the APEC economies formulate domestic systems to protect private information pursuant to the Principles.

Meanwhile, as business globalization advances, the challenge of protecting cross-border private information has emerged as the frequency of conveying this information across national borders increases. From this viewpoint, APEC established the CBPR system, aiming to protect private information under the APEC Information Privacy Principles even after such information is transmitted across borders.

Under the system, measures to protect cross-border private information of enterprises and other entities are certified if such measures are compatible with the APEC Information Privacy Principles. When enterprises and other entities apply for the certification, they will voluntarily examine their own rules and frameworks concerning cross-border private information in their companies and then the details of their efforts will undergo an examination by a neutral certification organization. Finally, the measures will be certified when the certifying organization recognizes that the measures are compatible with the APEC Information Privacy Principles.

2. Advantage of joining the system

Japan applied for participation in the system, following the United States and Mexico. In the future, if Japan is admitted to the system and the neutral certification organization is authorized, enterprises and other entities certified by this organization will be able to prove that the handling process of private information in their companies is compatible with the APEC Information Privacy Principles.
