The Government of Japan Received Approval to Join the APEC Cross-Border Privacy Rules System

On April 28, 2014, the Government of Japan received approval to join the APEC Cross-Border Privacy Rules (CBPR) System, a framework under which measures to protect personal information in cross-border transfer of data by enterprises or other entities in the APEC region are certified if such measures are in conformity with the APEC Information Privacy Principles.

1. Background and outline of the system

APEC established the APEC Information Privacy Principles in 2004, and has since been recommending that the APEC economies establish domestic systems to protect personal information in line with the Principles.

Meanwhile, as business globalization advances, the need for appropriate protection of personal information crossing national borders has increased. In light of this situation, APEC developed the CBPR system.

Under the system, measures to protect personal information in cross-border transfer of data by enterprises or other entities in the APEC region are certified if such measures are in conformity with the principles. In June 2013, Japan applied to join the system, and recently received approval.

2. Effect of joining the system

Japan received approval to participate in the system, following the United States and Mexico. In the next step of the process, APEC will approve Japan’s Accountability Agent, which will certify enterprises or other entities’ measures to protect personal information in cross-border transfer of data under the system. Enterprises that are certified by the Accountability Agent will be able to prove that the handling process of personal information in their companies is in conformity with the principles, which is expected to facilitate the business activities of Japanese enterprises in the APEC region.
