Agency for Natural Resources and EnergyCabinet Decision on the Cabinet Order to Specify the Enforcement Date of the Amended Electricity Business Act and other Cabinet Order

Regarding the Act for Partial Revision of the Electricity Business Act (hereinafter referred to as the “Amended Act”), which was enacted in the 185th extraordinary Diet Session in 2013, on June 27, 2014, the Cabinet decided to approve the Cabinet Order to stipulate the enforcement date of the provisions related to the Organization for Cross-regional Coordination of Transmission Operators (OCCTO)* and other entities as April 1, 2015, and also to organize the necessary provisions concerning the organization.

1. Details of the Revised Act

As an effort under the first phase of the Electricity System Reform, METI organized the provisions related to the OCCTO. The Amended Act was deliberated during the 185th Extraordinary Diet Session in 2013, enacted on November 13, 2013, and promulgated on November 20, 2013.

*Note: The Organization for Cross-regional Coordination of Transmission Operators (OCCTO) is a private entity which will be created under the provisions of the Amended Act, aiming to enhance the function to adjust the nationwide supply-demand balance as well as to contribute to securing the stable supply of electricity. The organization is a government-authorized corporation, over which the Government of Japan has strong supervisory authority, since the organization will provide services that are highly conducive to the public interest. For example, before the organization determines the articles of incorporation and selects or dismisses its executive officers, it is required to gain authorization from the government.

2. Outline of the Cabinet Orders

1) Order for Stipulating the Enforcement Date

Regarding the Amended Act, the provisions concerning the organization to be enforced on April 1, 2015.

2) Cabinet Order for Organizing the Relevant Cabinet Orders

In line with the enforcement of the Revised Act, necessary provisions accompanied by the creation of the organization are to be organized, including provisions for procedures concerning registration of incorporation and those that should be satisfied when national government employees are dispatched to the organization.
