Progress Made in the Regulatory Reform for Individual Enterprises-Results of efforts to utilize the System to Remove Gray Zone Areas and the System of Special Arrangements for Corporate Field Tests from April 1 to June 30, 2014 (April–June Period)-

On January 20, 2014, the Industrial Competitiveness Enhancement Act (hereinafter referred to as the “Act”) came into effect. Under the Act, the Government of Japan created the System to Remove Gray Zone Areas and the System of Special Arrangements for Corporate Field Tests. Concerning the two systems, the Ministry of Economy, Trade and Industry (METI) hereby announces that as the ministry in charge, it has compiled the results of requests submitted between April 1 and June 30, 2014 (April–June period).

Requests from entities for authorizing new business action plans under the Act During the April–June period from April 1 to June 30, 2014, METI received two requests submitted by five entities for authorizing new business action plans under the Act. In response, the Minister of Economy, Trade and Industry authorized the requests as follows:

  • Title: Introduction of ultrasonic testing method into an inspection process of gas containers used in manufacturing semiconductors
    The request was jointly submitted by four entities, namely, Toshiba Corporation (Minato Ward, Tokyo), Kansan Corporation (Shibukawa City, Gunma Prefecture; an SME), A-Tec Corporation (Akashi City, Hyogo Prefecture; an SME), and Nippon Physical Acoustics, Ltd. (Shibuya Ward, Tokyo; an SME), and authorized by the METI minister on May 23, 2014.
  • Title: Commercialization of Fuel Cell Forklifts with a New Type of Hydrogen Tank
    The request was submitted by Toyota Industries Corporation (Kariya City, Aichi Prefecture), and authorized by the METI minister on July 27, 2014.

2. Future schedule

Concerning the System of Special Arrangements for Corporate Field Tests, METI will proceed toward creating special measures concerning specific regulations by examining each request, including calling for public comment and developing related ministerial ordinances under the Act. Following this step, entities that wish to use the special measures will submit requests to METI for authorization of new business action plans pursuant to the Act. Once such plans are authorized by ministers in charge of the new proposed businesses, the entities will be able to start the new business, using the special measures concerning the specific regulations.
