Japan Patent OfficeThe JPO and the Intellectual Property Corporation of Malaysia Strengthen Cooperation in Intellectual Property

The Japan Patent Office (JPO) and the Intellectual Property Corporation of Malaysia (MyIPO) agreed to commence a Patent Prosecution Highway (PPH) program on October 1, 2014. As a result, the number of Japan’s PPH partners now comes to 30 countries and regions. The PPH program will allow Japanese companies to obtain patent rights quickly in Malaysia and also will lead to the facilitation of their business expansion in the country.

1. Background

As the globalization of the world economy advances, the number of filed patent applications tends to increase worldwide, including those filed by Japanese enterprises with overseas patent offices.

Note: In 2012, 1,248 applications were filed with the MyIPO from Japan.

2. PPH pilot program between the JPO and the MyIPO

The JPO and the MyIPO agreed to commence a PPH pilot program on October 1, 2014.

The program allows patent applicants whose applications have been determined as patentable by the JPO to request an accelerated examination of the corresponding applications in the MyIPO through a simple procedure.

As a result of this agreement, the number of Japan’s PPH partners now comes to 30 countries and regions. As for ASEAN countries, Malaysia is the fifth partner country, following Singapore, the Philippines, Indonesia, and Thailand.

With a view to helping Japanese applicants obtain stable overseas patents promptly, the JPO will continue making efforts to increase the number of PPH partners and to harmonize and simplify patent application procedures in cooperation with the IP offices overseas.
