Joint Press Release with the Ministry of the EnvironmentCabinet Decision on a Cabinet Order for Specifying the Necessary Matters Concerning the Enforcement of the Fluorocarbons Recovery and Destruction Law

On March 24, 2015, the Cabinet approved the Cabinet Order for the Partial Revision of the Order for Enforcement of the Act for Partial Revision of the Act on Ensuring the Implementation of Recovery and Destruction of Fluorocarbons concerning Designated Products (hereinafter referred to as the “Revised Fluorocarbons Recovery and Destruction Law”), which was established in the FY2013 ordinary session of the Diet.

The approved Cabinet Order is to further stipulate the provisions to define products using fluorocarbons, i.e., air conditioners, heat insulators, and dust blowers, which are to be controlled under the Revised Fluorocarbons Recovery and Destruction Law, to require businesses subject to the control under the Law to submit a report to the government, and to conduct on-site inspections of such businesses under the Law by the government.

The Cabinet Order will be enforced from April 1, 2015.

1. Revision of the Cabinet Order

The FY2013 ordinary session of the Diet established the Revised Fluorocarbons Recovery and Destruction Law to address surging fluorocarbons emissions that have strong greenhouse effects, particularly in the field of refrigeration and air conditioning units. The Revised Fluorocarbons Recovery and Destruction Law is to stipulate control measures for fluorocarbons including: [i] requesting importers and manufacturers of fluorocarbons as well as products which contain fluorocarbons to use the substances rationally; and [ii] requesting users of refrigeration and air conditioning units to manage the substances appropriately.

METI hereby announces that on March 24, 2015, the Cabinet approved a Cabinet Order to specify the necessary matters concerning the enforcement of the Revised Fluorocarbons Recovery and Destruction Law.

2. Outline of the Cabinet Order

The approved cabinet order is to further stipulate the provisions to define products using fluorocarbons, i.e., air conditioners, heat insulators, and dust blowers, which are to be controlled under the Revised Fluorocarbons Recovery and Destruction Law, to require businesses subject to the control under the Law to submit a report to the government, and to conduct on-site inspections of such businesses under the Law by the government.
