    Cabinet Decision on the Bill for the Act for the Improvement of the Energy Saving Performance of Buildings

    On March 24, 2015, the Cabinet decided to approve the Bill for the Act for the Improvement of the Energy Saving Performance of Buildings. The bill will be submitted to the 189th ordinary session of the Diet.

    1. Purpose of the bill

    As the socioeconomic circumstances change, the energy consumption in buildings has been significantly growing. In light of the fact, the Japan Revitalization Strategy, which was approved by the Cabinet on June 14, 2013, stipulates that the government should require businesses to satisfy the standards for energy saving performance (hereinafter referred to as the “standards”) subject to newly constructed houses and buildings, which are scheduled to be introduced step by step by 2020, aiming to further promote the energy saving approaches to buildings.

    For the purpose of improving the energy saving performance of buildings, the bill is to stipulate new measures, including those to require conformity to standards for improving the energy saving performance of non-residential buildings of a size beyond that predetermined in the provisions, and to establish a system for authorizing a plan submitted by businesses to improve energy saving performance.

    2. Outline of the bill

    Major measures stipulated in the bill are as follows:

    1. Obligation to conform to standards and to judge the conformity to the standards concerning large, non-residential buildings

      Concerning large, non-residential buildings (specified buildings), the Act is to require businesses to conform to the standards and to judge their conformity when they construct a new building and to ensure such conformity through the construction certification procedures.

    2. Obligation to submit an energy saving plan concerning construction of buildings bigger than medium size

      Concerning buildings bigger than medium size, the Act is to require businesses to submit an energy saving plan when they construct a new building. However, when such a building does not satisfy the standards, an administrative agency with the appropriate jurisdiction, is allowed to instruct such businesses if necessary.

    3. Authorizing a plan for improving energy saving performance of buildings (special arrangement for floor area ratios)

      Concerning buildings with excellent energy saving characteristics, the Act is to provide businesses with an entitlement to enjoy a special arrangement for floor area ratios when such businesses are authorized by an administrative agency with the appropriate jurisdiction.

    4. Allowing businesses to indicate energy saving performance

      Concerning buildings that satisfy the standards, the Act is to allow businesses to indicate that the buildings satisfy the standards when the businesses are authorized to be in conformity by an administrative agency with the appropriate jurisdiction.
