Additional Control Measures on Class I Specified Chemical Substances under the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc. were Compiled

On September 18, 2015, the Chemical Substances Council concluded control measures for certain products using polychlorinated naphthalene containing two chlorine atoms as well as pentachlorophenol and its salts and esters which should be subject to import embargoes.

1. Background

In June 2015, the Chemical Substances Council concluded that both polychlorinated naphthalene containing two chlorine atoms, and pentachlorophenol and its salts and esters,*1 should be designated as Class I Specified Chemical Substances under the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc. (Act No. 117 of 1973; hereinafter referred to as the “Act”).

*1: Polychlorinated naphthalene containing two or more chlorine atoms, and pentachlorophenol and its salts and esters were designated as chemical substances subject to elimination at the 7th meeting of the Conference of the Parties to the Stockholm Convention on Persistent Organic Pollutants in May 2015. Polychlorinated naphthalenes containing three or more chlorine atoms were already designated as Class I Specified Chemical Substances under the Act in 1979.

2. Results of the examination

Pursuant to Articles 17 and 22 of the Act, entities that intend to manufacture or import the chemical substances designated as Class I Specified Chemical Substances are required to obtain prior permission. In addition to these measures, the Chemical Substances Council, on September 18, 2015, concluded that the following specific control measures should be taken:: Dr. Fumihiko Kimura, Professor at Hosei University) examined the applications and selected the winners of the respective Minister’s Prizes from the related ministries, including the Prime Minister’s Prize, the METI Minister’s Prize, and also the 3Rs Promotion Council President’s Prize.

  • 1. Products using Class I Specified Chemical Substances that are designated by a Cabinet Order should be subject to import embargoes, pursuant to paragraph (1), Article 24 of the Act:

    Among the products using polychlorinated naphthalene containing two chlorine atoms, three kinds of products that are similar to those prohibited imports that use polychlorinated naphthalenes containing three or more chlorine atoms should be subject to import embargoes.

    • Lubricating and cutting oils
    • Wood antiseptics, insecticides, and fungicides
    • Paints (limited to those for antiseptic, insecticidal, and fungicidal use)

    In addition, among the products using pentachlorophenol and its salts and esters, four kinds of products, which may be imported into Japan, should be subject to import embargoes.

  • 2. Essential use that is exempted from the prohibition of the usage of Class I Specified Chemical Substances specified by a Cabinet Order, pursuant to Article 25 of the Act

    Both polychlorinated naphthalene containing two chlorine atoms, and pentachlorophenol and its salts and esters thereof are able to be replaced by alternatives. Accordingly, it is appropriate to introduce measures to ban all usage of these substances.

3. Future schedule

The Ministry of Economy, Trade and Industry, the Ministry of Health, Labour and Welfare, and the Ministry of the Environment will advance necessary procedures, including calling for public comment on the amendment of the Cabinet Order based on the results of the examination.
