Cabinet Approves the Cabinet Order on the Partial Revision of the Order for Enforcement of the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc.

On February 26, 2016, the Cabinet decided to approve the Cabinet Order on the Partial Revision of the Order for Enforcement of the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc.
This Cabinet Order designates polychlorinated naphthalene containing two chlorine atoms and pentachlorophenol and its salts and esters as Class I Specified Chemical Substances and also designates products that are to be prohibited imports in case such substances are used.

1. Outline of the revision

Polychlorinated naphthalene containing two chlorine atoms and pentachlorophenol and its salts and esters are to be additionally designated (Article 1 of the Order for Enforcement of the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc.) as Class I Specified Chemical Substances (Note 1) designated under the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc. (hereinafter referred to as the “Act”). Therefore, measures for requiring entities that intend to manufacture or import such substances to obtain prior permission are to be taken.

Also, the following products are to be designated (Article 7 of the Order for Enforcement of the Act) as products that are prohibited imports in case such substances are used.

Products that are to be prohibited imports in case polychlorinated naphthalene containing two chlorine atoms is used
(1) Lubricating and cutting oils
(2) Wood antiseptics, insecticides, and fungicides
(3) Paints (limited to those for antiseptic, insecticidal, and fungicidal use)

Products that are to be prohibited imports in case pentachlorophenol and its salts and esters is used
(1) Wood antiseptics, insecticides, and fungicides
(2) Wood treated with antiseptics, insecticides, or fungicides
(3) Plywood treated with antiseptics, insecticides, or fungicides
(4) Glues

2. Future schedule

Promulgation: March 2, 2016

Entry into force
  1. April 1, 2016, for the designation of polychlorinated naphthalene containing two chlorine atoms and pentachlorophenol and its salts and esters as Class I Specified Chemical Substances
  2. October 1, 2016, for the designation of the products that are to be prohibited imports if such products use polychlorinated naphthalene containing two chlorine atoms or pentachlorophenol and its salts and esters

(Note 1) Class I Specified Chemical Substances are persistent and highly bioaccumulative and have long-term toxicity for humans and predator animals at higher trophic levels. The Act requires entities to gain permission before manufacturing and importing designated substances, which are prohibited in principle, limits the use of the substances, and bans imports of certain products designated by cabinet orders.
