Joint Press Release with the Japan Fair Trade CommissionMETI and the JFTC Revise the Guidelines for Proper Electric Power Trade

The Ministry of Economy, Trade and Industry (METI) hereby announces that METI and the Japan Fair Trade Commission (JFTC) have jointly revised the Guidelines for Proper Electric Power Trade in response to the entry into force of the Act for Partial Revision of the Electricity Business Act in April 2016.

In December 1999, METI and the JFTC jointly created and publicized the Guidelines for Proper Electric Power Trade, which clarify matters such as trade practices that may constitute infringements under the Antimonopoly Act or the Electricity Business Act from the perspective of fair and effective competition in the electricity market, and METI and the JFTC have revised the Guidelines six times since then. METI and the JFTC have once again jointly revised the Guidelines in response to various matters including the entry into force of the Act for Partial Revision of the Electricity Business Act in April 2016.

During this revision of the Guidelines, METI and the JFTC publicized a draft of the revision on December 17, 2015, inviting feedback from a wide variety of sources, specifying January 19, 2016 as the deadline for submitting such opinions, and received 28 submissions. (In some cases, one submission included multiple opinions.) METI and the JFTC carefully discussed the submitted opinions and consequently decided to partially amend the draft.

To ensure fair and effective competition in the electricity market, the JFTC and METI are to use the Guidelines to prevent trade practices that may be problematic under the Antimonopoly Act or the Electricity Business Act by thoroughly publicizing the Guidelines, while continuing to appropriately enforce these Acts.
