Agency for Natural Resources The Cabinet Approved the Cabinet Orders for Stipulating the Effective Date of the Spent Nuclear Fuel Reprocessing Implementation Act

Concerning the Act for Partial Revision of the Spent Nuclear Fuel Reprocessing Implementation Act (hereinafter referred to as the “Revised Act”), which was established during the ordinary session of the Diet in 2016, on September 27, 2016, the Cabinet approved a cabinet order which stipulates the effective date of the Revised Act and a cabinet order outlining the development of related cabinet orders which need revision along with the enforcement of the Revised Act and which stipulates transitional measures required for enforcement.

1. Outline of the Spent Nuclear Fuel Reprocessing Implementation Act

The revision of the Act was discussed during the ordinary session of the Diet in 2016 and the Revised Act was established in May 2016. Aiming to both ensure and efficiently execute the reprocessing, etc. of spent nuclear fuel resulting from nuclear power generation, the environment where the liberalization of entry of new businesses into the electricity retail market has been introduced, the Revised Act stipulates new provisions to change the existing funding system in which businesses accumulate necessary funds in external organizations and introduces a new funding system in which a new authorized fund management corporation will be established to administer such reprocessing and other work, and in which businesses will contribute necessary funds to the corporation.

2. Summary of the Bill of the Cabinet Orders, which was approved by the Cabinet

1) Cabinet order stipulating the effective date of the Spent Nuclear Fuel Reprocessing Implementation Act

  • The effective date of the Revised Act was stipulated to be October 1, 2016.

2) Cabinet order for developing related cabinet orders required to be revised along with the enforcement of the Revised Act and for stipulating necessary, transitional enforcement measures

  • The newly-added provisions concerning the delegation of transitional measures to cabinet orders under the Revised Act stipulate that the cabinet order will stipulate new, streamlined provisions concerning the definitions related to the reprocessing, etc. of spent nuclear fuel, and concerning the entities which will undertake the reprocessing work under the direction of the Nuclear Reprocessing Organization of Japan, as well as other provisions concerning related cabinet orders.
  • The cabinet order stipulates new streamlined transitional measures required due to the shift of the funding system from an accumulation-based system to a contribution-based system.
