  • Cabinet Approved Two Cabinet Orders: the Cabinet Order for Stipulating the Effective Date of the Act for Partial Revision of the Basic Act on Cybersecurity and Partial Revision of the Act on Facilitation of Information Processing, and the Cabinet Order for Partial Revision of the Order for Enforcement of the Act on Facilitation of Information Processing

Cabinet Approved Two Cabinet Orders: the Cabinet Order for Stipulating the Effective Date of the Act for Partial Revision of the Basic Act on Cybersecurity and Partial Revision of the Act on Facilitation of Information Processing, and the Cabinet Order for Partial Revision of the Order for Enforcement of the Act on Facilitation of Information Processing

Concerning the Act for Partial Revision of the Basic Act on Cybersecurity and Partial Revision of the Act on Facilitation of Information Processing (hereinafter referred to as the “Act for Revision”), which was established at the 190th ordinary session of the Diet, the Cabinet approved the Cabinet Order for Stipulating the Effective Date of the Act for Revision (hereinafter referred to as the “Cabinet Order for Effective Date”) and the effective date was determined to be October 21, 2016. In line with this, the Cabinet also approved the Cabinet Order for Partial Revision of the Order for Enforcement of the Act on Facilitation of Information Processing (hereafter referred to as the “Cabinet Order for Revision”) to stipulate predetermined provisions.

1. Purpose of the Act for Revision

In light of the growing serious threats to cybersecurity, the Act for Revision aims to dramatically fortify the existing measures in the administrative organizations under the government of Japan and also to take new measures for enhancing cybersecurity, including inaugurating a new national qualification system for developing experts in the field of cybersecurity.

2. Summary of the Bills of the Cabinet Orders, which were approved by the Cabinet

The Cabinet Order for Effective Date will stipulate the effective date of the Act for Revision to be October 21, 2016. In addition, under the Revised Act on Facilitation of Information Processing pursuant to the Act for Revision, the Cabinet Order for Revision will stipulate the details of the newly-created IT Security Support Provider system, including grounds for disqualification of such support providers, the amount of examination fees and other matters, as follows:

  • The Cabinet Order for Revision will stipulate that:
    1. The provisions of the information processing act concerning the grounds for disqualification should be the provisions of: Articles 168 (2) and 168 (3) of the Penal Code and Articles 11 to 13 of the Act on Prohibition of Unauthorized Computer Access.
    2. The amount of fees for the IT Security Support Provider examination should be 5,700 yen.
    3. The amount of fees for changing registered information on IT Security Support Providers should be 900 yen.
    4. The amount of fees for registering IT Security Support Providers should be 10,700 yen.
