Cabinet Decision on the Cabinet Order to Partially Revise the Export Trade Control Order

From the standpoint of preventing the proliferation of weapons of mass destruction and the excessive accumulation of conventional weapons, and executing treaties and other international agreements, the Ministry of Economy, Trade and Industry (METI) has controlled exports of goods under the Foreign Exchange and Foreign Trade Act and has also provided individual provisions to regulate goods based on Japan’s Foreign Exchange Order and the Export Trade Control Order under the Foreign Exchange and Foreign Trade Act.
On November 1, 2016, the Cabinet approved the requested revision of the Export Trade Control Order concerning [i] goods in the export regulatory list based on the agreements concluded at the International Export Control Conference held in 2015 and [ii] the removal of some agricultural, forestry, and fishery goods from the regulatory list in light of the recent situation of domestic supply and demand. METI hereby announces the revisions.

1. Outline of the revision

  • The order is to be revised concerning goods in the regulatory list so that the government of Japan can ensure domestic implementation of the agreements concluded at the International Export Control Conference (related to Appended Table 1 of the order).
  • The order is to be revised to remove some agricultural, forestry, and fishery goods from the regulatory list in light of the recent situation of domestic supply and demand (related to Appended Table 2 of the order).
  • The order is to be revised to remove Liberia from the list of the areas subject to strict export control, in accordance with the UN Security Council’s adopting Resolution 2288 to lift the sanction measures over the arms embargo imposed on Liberia. (related to Appended Table 3-2 of the order).

The details of the revision are as follows:

Related to Appended Table 1 of the order

  • Removal of piezoelectric polymers or other substances composed of vinylidene fluoride from the regulatory list (Partial revision of Appended Table 1, column 5)
  • Removal of liquids (hydraulic fluids) mainly containing silahydrocarbon oils or other substances from the regulatory list (Partial revision of Appended Table 1, column 5)
  • Removal of copolymers composed of vinylidene fluoride from the regulatory list (Partial revision of Appended Table 1, column 5)
  • Addition of devices having functions of analog-to-digital conversion, including waveform digitizers and transient recorders, and other devices to the regulatory list (Partial revision of Appended Table 1, column 7)
  • Addition of digital recorders, including digital instrumentation recorders using a magnetic disk storage technique, to the regulatory list (Partial revision of Appended Table 1, column 7)
  • Removal of information and telecommunications systems with a security function or other components from the regulatory list (Partial revision of Appended Table 1, column 9)
  • Removal of underwater vision systems from the regulatory list (Partial revision of Appended Table 1, columns 10 and 12)

Related to Appended Table 2 of the order

  • Removal of wheat bran, rice bran, and oat bran from the regulatory list (Removal of Appended Table 2, column 28, from the order)
  • Removal of feed mixtures from the regulatory list (Removal of Appended Table 2, column 29, from the order)
  • Removal of logs of kalopanax pictus and quercus from the regulatory list (Removal of Appended Table 2, column 32, from the order)

Related to Appended Table 3-2 of the order

  • Removal of Liberia from the list of the areas subject to strict export control

Note: In line with the revisions in the Export Trade Control Order, METI will also revise the related ordinances, public notices and other regulations.
