The Japan Patent Office JPO-ROSPATENT Cooperation to be Advanced in the Field of Industrial Property
On December 16, 2016, the Japan Patent Office (JPO) and the Federal Service for Intellectual Property (ROSPATENT) of the Russian Federation signed a Memorandum of Cooperation (MOC) in the field of industrial property. The JPO will continue to further make efforts, in cooperation with the ROSPATENT, to establish the environment in which Japanese companies can obtain IP rights smoothly and the IP rights are protected properly in Russian Federation.
In recent years, Russia has increasingly been recognized as a promising investment target, being one of the BRICs countries with a dramatically developing economy. As advancing the development of business in Russia, Japanese companies have tended to file a growing number of patent applications with the ROSPATENT, reaching around 1,600 applications in 2014, which is approximately a fivefold increase from around 300 a decade ago.
The JPO and the ROSPATENT have been advancing a variety of cooperative efforts, including the commencement of the Patent Prosecution Highway (PPH) program* in 2009. In response to the increase of Japanese companies’ interest in Russia, the JPO and the ROSPATENT signed the MOC in Tokyo. The MOC is an effort for supporting the Japanese industrial world in terms of the intellectual property area in developing their investment and business in Russia, a country gathering global attention as an emerging market.
*Note: The Patent Prosecution Highway (PPH) is a framework in which an application determined to be patentable in the Office of Earlier Examination (OEE) is eligible to have an accelerated examination in the Office of Later Examination (OLE) with a simple procedure upon an applicant’s request.
2. Outline of the JPO-ROSPATENT memorandum of cooperation
Through the MOC, the JPO and the ROSPATENT confirmed that they will cooperate in a variety of fields, including the following efforts. This MOC is expected to encourage Japanese companies to further facilitate their global business development through Japan’s support in further improving the environment in Russia for protecting IP rights of Japanese companies.
- Sharing information on national policies for IP rights, legal systems, examination guidelines, etc.
- Sharing experience involving examination systems in both offices and other IT infrastructures
- Advancing cooperation in the field of examination, including sharing examination experience
- Advancing cooperation under the international frameworks, including the PPH programs
- Advancing cooperation in protecting intellectual property rights under the collaboration efforts with related ministries and agencies
- Promoting interaction between users and both offices
3. Future actions
The JPO will continue to further make efforts, in cooperation with the ROSPATENT, to establish the environment in which Japanese companies can obtain IP rights smoothly and the IP rights are protected properly in Russian Federation.
