The Japan Patent Office Patent Granting in Brunei Darussalam to be Facilitated Commencement of the Patent Prosecution Highway Plus (PPH Plus) Program between Japan and Brunei Darussalam

On August 28, 2017, the Japan Patent Office (JPO) agreed, in Bandar Seri Begawan, Brunei Darussalam, with the Brunei Darussalam Intellectual Property Office (BruIPO) on the commencement of new patent examination cooperation. This cooperation framework aims to facilitate patent examination procedures of the BruIPO to make use of the examination results obtained from the JPO. This effort will support companies and other entities obtain patent rights in Brunei Darussalam.
The JPO will continue to fortify its cooperation with IP offices in the ASEAN regions, including Brunei Darussalam, and support companies in further facilitating their international business development.

1. Outline

The JPO has been supporting IP offices in the ASEAN region in developing and fortifying intellectual property systems from the perspective of enhancing investment environments, so as to support the facilitation of overseas business development by companies.

As part of this effort, on August 28, 2017, the JPO agreed with the BruIPO on the commencement of the Patent Prosecution Highway Plus (PPH Plus) program, a new JPO-BruIPO cooperation framework in patent examination. This framework aims to facilitate the BruIPO to make use of the examination results obtained from the JPO.

2. Outline of the PPH Plus program

This is a framework in which it becomes possible for the applicant, who has been granted a patent for an application in Japan, to request for an accelerated examination procedure based on the examination result in Japan and promptly obtain patent rights for an application with the same content in Brunei.

3. Future actions

Aiming to start the cooperation framework from October 1, 2017, the JPO will advance coordination with the BruIPO for formulating guidelines that describe specific procedures for filing a request under the program and other information. The guidelines are scheduled to be publicized on the JPO and BruIPO websites.
