Cabinet Decision on the Cabinet Order for Stipulating the Enforcement Date of the Act for Partial Revision of the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc.

Under the provisions of Article 1 (excluding paragraph (1)) of the Supplementary Provisions of the Act of Partial Revision of the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc. (Act No. 53 of 2017; hereinafter referred to as the “Revised Act”), which was established at the ordinary session of the Diet in 2017, the Cabinet, on December 8, 2017, approved the Cabinet Order for Stipulating the Enforcement Date of the Act for Partial Revision of the Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture, etc.

1. Outline of the Revised Act

In recent years, chemical industries in Japan have been shifting to the production of a diverse array of functional chemical substances in small quantities. In light of this trend, Japan needs to use more appropriate measures, while remaining dedicated to protecting the environment from being polluted by chemical substances. To this end, the Revised Act is to amend the Special Arrangements for Evaluation Requirements under which the total production quantity of new chemical substances across Japan is controlled from the existing control measures targeting the total quantity involved in manufacturing and imports of such new substances, to new measures targeting the total quantity involved in environment emission, i.e., the total quantity of the substances emitted into the environment. Besides, the Revised Act is to stipulate enhanced measures to appropriately monitor chemical substances which are comparatively highly toxic among those categorized in general chemical substances.

The Revised Act was discussed at the ordinary session of the Diet in 2017 and promulgated on June 7, 2017.

2. Summary of the cabinet order

Regarding the Revised Act, the provisions for revision of the management of highly toxic new chemical substances shall come into force on April 1, 2018, while those for revision of the upper limit on the production quantity across Japan under the Special Arrangements shall come into force on January 1, 2019.
