Announcement of Starting Application of the Agreement on Comprehensive Economic Partnership among Member States of the Association of Southeast Asian Nations and Japan (AJCEP) between Japan and Indonesia
On March 1, 2018, Japan and Indonesia started the application of the Agreement on Comprehensive Economic Partnership among Member States of the Association of Southeast Asian Nations and Japan (AJCEP). The starting of application of the agreement is in line with that of the ministerial regulations under the name of the Minister of Finance, Indonesia, necessary for entry into force. The agreement was promulgated on February 15, 2018, and entered into force on March 1, 2018.
1. Application of tariff rates under the AJCEP
On March 1, 2018, the day on which the ministerial regulations come into force in Indonesia, Japan and Indonesia started the application of preferential tariff rates* between the countries under the AJCEP.
2. Issuance of Certificates of Origin (CO) under the AJCEP
From March 1, 2018, the day on which the ministerial regulations come into force in Indonesia, entities intending to export goods from Japan to Indonesia may apply for issuance of the Co to the Japan Chamber of Commerce and Industry (JCCI). In addition, if goods exported from Japan to Indonesia are those subject to Rule 7 of the AJCEP Implementing Regulations,** exporters may retroactively apply for issuance of the CO of the goods to JCCI.
**Note 2: Rule 7: Retroactive Issuance of Certificate of Origin
In principle, a CO is to be issued by the time of shipment or no later than three (3) days from the date of shipment. In exceptional cases where a CO has not been issued by the time of shipment or no later than three (3) days from the date of shipment, at the request of the exporter, the CO will be issued retroactively in accordance with the laws and regulations of the exporting party within twelve (12) months from the date of shipment, in which case it is necessary to tick the box marked “Issued Retroactively.” In such cases, the importer of the good who claims the preferential tariff treatment for the good may, subject to the laws and regulations of the importing party, provide the customs authority of the importing party with the CO issued retroactively. The CO issued retroactively will indicate the date of shipment in box 3.
