JPO Compiles Three IP Content Documents for Vitalization of Venture Ecosystem

The Japan Patent Office (JPO) hereby announces that it compiled three content documents: (1) IP Strategies for Startups, a collection of intellectual property (IP) strategic case examples of venture businesses at home and overseas, (2) IP Open Innovation, a collection of IP best practices for open innovation initiatives, and (3) SKIPDD, a guide for standard knowledge for IP due diligence.

1. Background

Venture businesses and startups often engage in business at the technological frontier, and are thus expected to both promote industrial rejuvenation and lead open innovation initiatives through collaboration with large enterprises or SMEs.

With this in mind, it is important for venture businesses and startups to treat their innovative technologies and ideas as property, and this requires them to intentionally be committed to the establishment of IP strategies, an approach to developing policies and systems for right’s acquisition, know-how development, and licensing. However, many venture businesses do not recognize the importance of developing such strategies, with approximately only 20% of all such businesses having established IP strategies before beginning operations.*

Moreover, and importantly, smooth promotion of open innovation initiatives between large enterprises or SMEs and venture businesses requires well-organized approaches to handling ownership of IP derived from collaboration between parties.

To address this situation, the JPO decided to compile referential content documents of useful information from three viewpoints and hereby releases them. Through these documents, the JPO aims to vitalize a venture ecosystem in Japan.

2. Outlines of the documents

(1) IP Strategies for Startups, a collection of IP strategic case examples of venture businesses at home and overseas

This document focuses on ten domestic and eight overseas (Israeli, Germany, Singapore and China) venture businesses and explains their business policies, IP strategies, collaboration systems with external experts, case examples of IP utilization, and other information.

(2) IP Open Innovation, a collection of IP best practices for open innovation initiatives

This document features challenges that large enterprises or SMEs and venture businesses may face in advancing their open innovation initiatives and measures to solve such challenges, and explains categorization of collaboration by purpose and approaches to advancing related processes, roles that IP departments should play, approaches to handling IP derived from collaboration, and other information.

(3) SKIPDD, a guide for standard knowledge for IP due diligence

This document is a collection of step-by-step instructions called a standard operating procedure (SOP), according to which a company intending to invest in, collaborate with or conduct M&A of a venture business evaluates the IP-oriented risk and value (IP due diligence) of the target venture company. The document explains the basic processes and key points of IP due diligence.

The term “SKIPDD” is an acronym for “Standard Knowledge for Intellectual Property Due Diligence.”
The term “SOP” is an acronym for “Standard Operating Procedure.”

The JPO will proactively disseminate these documents aiming to vitalize a venture ecosystem through their effective utilization of IP.
