Japan Patent Office JPO Agreed with IMPI to Expand Cooperation in the Field of Industrial Property

On June 4, 2018, the Mexican Institute of Industrial Property (IMPI) and the Japan Patent Office (JPO) signed a memorandum of cooperation (MOC) to expand cooperation in the field of industrial property (IP). The JPO will continue to make further efforts, in cooperation with the IMPI, to establish an environment in which Japanese companies can obtain IP rights smoothly and the IP rights are properly protected in Mexico.

1. Background

As Mexico ranks in the top 20 countries in the world in both economic scale and population, many Japanese companies--mainly in the automobile and other manufacturing industries-- have developed business in the country taking advantage of the benefits of tariff agreements under the North American Free Trade Agreement (NAFTA). Along with this business development trend, a growing number of patent applications have been filed from Japan in IMPI, with an approximate two-fold increase over this decade.

In February 2012, IMPI and JPO signed an MOC in the field of IP. Since then, JPO has been accepting trainees from IMPI and other entities in the field of IP, and both sides have also been advancing cooperation by a variety of means, including the IMPI-JPO examiner exchange program since 2012. Moreover, taking the opportunity of the 130th anniversary of the establishment of Mexico-Japan diplomatic ties in November 2018, H.E. Mr. Enrique Peña Nieto, President of Mexico, and Prime Minister Shinzo Abe confirmed in November 2017 that the two countries would further vitalize the Mexico-Japan relationship.

In light of this situation, as an effort to further expand IMPI-JPO cooperation, Mr. Miguel Ángel Margáin, the Director-General of the IMPI, and Ms. Naoko Munakata, Commissioner of the JPO, signed a MOC to enhance efforts for the exchange of IP data (e.g., gazettes) between the Offices and efforts for mutually providing general public with information about each Office’s national IP right system in English. The signing ceremony of the MOC was held with the attendance of H.E. Mr. Carlos Fernando Almada López, Ambassador of Mexico in Japan, and Mr. Sergio Inclán, Minister of Mexico in Japan.

2. MOC with IMPI

Through the MOC, the IMPI and the JPO confirmed that they will cooperate in the following efforts. This MOC is expected to encourage Japanese companies to further facilitate their global business development through JPO’s support in further developing the environment in Mexico for protecting the intellectual property rights of Japanese companies.

  1. Promotion of public awareness of the importance of IP;
  2. Human resource development and targeted training for the officials of the Offices;
  3. Exchanging of information on IP systems and practices of at the Offices, such as IP strategy, international treaties, legislation, regulations, guidelines and manuals, as well as statistical data on IP administration in IP field;
  4. Cooperation in the field of Information Technology;
  5. Cooperation on substantive examinations including the Patent Prosecution Highway (PPH);
  6. Collaboration in international forums with which the Offices are involved with, such as the Asia-Pacific Economic Cooperation (APEC);
  7. Exchange of IP data between the Offices, such as gazettes;
  8. Collaboration in order to provide general public with information about each Office’s national IP rights system, preferably in English; and
  9. Any other modality of cooperation decided by the Offices

3. Future actions

Through enhanced cooperation with IMPI based on the MOC, the JPO will continue to further make efforts to establish the environment in which Japanese companies can obtain IP rights smoothly and the IP rights are protected properly in Mexico.
