Toward the Determination of the Production/Consumption Limits for Japan

Based on Article 3 of the Supplementary Provisions of the Act Partially Amending the Act on the Protection of the Ozone Layer through the Control of Specified Substances and Other Measures, which was promulgated on July 4, 2018, the Ministry of Economy, Trade and Industry (METI) will collect reports from businesses that produced, imported or exported the substances set forth in Annex F of the Montreal Protocol (hydrofluorocarbons (HFC)) from 2011 to 2013.

1. Background

The Montreal Protocol on Substances that Deplete the Ozone Layer (adopted in 1987), which imposed the obligation to reduce chlorofluorocarbon (CFC) emissions, was amended and re-adopted in October 2016 (Kigali Amendment to the Montreal Protocol). Through the amendment, the obligation of emission reduction was newly introduced for HFC, which also have influence on global warming.

In order to fulfil this reduction obligation, the government of Japan partially amended the Act on the Protection of the Ozone Layer through the Control of Specified Substances and Other Measures (the "Ozone Layer Protection Act") as a domestic response measure to regulate the production and import of HFC in Japan. The Act for partial amendment was promulgated on July 4, 2018.

2. Outline

With this promulgated Act, the amended Ozone Layer Protection Act will come into force from January 2019 and the production and import of HFC will then be regulated on that basis.

Ahead of the introduction of new regulations in January 2019, it is necessary to determine the production and consumption limits for HFC that Japan is to observe under the Montreal Protocol. Therefore, METI will collect reports concerning the amounts of production, imports or exports from businesses that produced, imported or exported the substances set forth in Annex F of the Montreal Protocol (HFC) from 2011 to 2013.

  1. Firstly, it is necessary to ascertain which businesses produced, imported or exported HFC from 2011 to 2013. Therefore, companies that produced, imported or exported the types of HFC subject to regulations under the amended Ozone Layer Protection Act (see p.4 of the related information ((1) below) for details) from 2011 to 2013, or companies that consider themselves equivalent such companies are asked to notify the Ozone Layer Protection Policy Office.
  2. Businesses that produced, imported or exported types of HFC subject to regulations from 2011 to 2013 are also asked to submit a report on the amounts produced, imported or exported by August 1.

3. Future schedule

July 24, 2018: Notification to the Ozone Layer Protection Policy Office
August 1, 2018: Deadline for the submission of reports
September 2018 onward: Publication of Japan's production/consumption limits
January 1, 2019: Enforcement of the amended Ozone Layer Protection Act
