Partial Revision of the Foreign Exchange Order and the Export Trade Control Order
In the interest of preventing the proliferation of weapons of mass destruction and the accumulation of conventional weapons, with regard to security export control, the Government has included in its list the articles to be regulated under the International Export Control Conference in which Japan and many key countries participate.
In light of this international consensus list, the targeted technologies and items will be deemed restricted items by their inclusion in Article 25 (1) of the Ordinance of the Ministry of Economy, Trade and Industry (the “Foreign Exchange Order”) and Article 48 (1) of the Export Trade Control Order (the “Export Order”), and be deemed items against which collateral shall be provided under national law.
In light of the International Export Control Conference, the purpose of this Cabinet Order is to newly designate technologies and items for which authorization from the Minister of Economy, Trade and Industry is mandatory if they are to be exported or provided.
1. Overview of the Revision
Pursuant to the above international agreement, the following items will be added to the list of goods and technologies for which permission from the Minister of Economy, Trade and Industry must be obtained prior to export or provision:
- Technology for the use of biological weapon manufacturing equipment, etc. (Item 3.2, Appended Table of the Foreign Exchange Order)
- Technology for the design or manufacture of integrated circuits for communications equipment (Item 9, Appended Table of the Foreign Exchange Order)
- Components of poison gas detectors (Item 3, Appended Table 1 of the Export Control Order)
- Semiconductors and other devices for electric power regulation, etc. (Item 7, Appended Table 1 of the Export Control Order)
- Information and communications systems capable of protecting confidential information (Item 9, Appended Table 1 of the Export Control Order)
- Underwater sound equipment designed for keeping divers off or for similar purposes (Item 10, Appended Table 1 of the Export Control Order)
- Automatic explosive detectors (Item 14, Appended Table 1 of the Export Control Order)
