Administrative Sanction (Export Ban) under the Foreign Exchange and Foreign Trade Law
In relation to violation of the Foreign Exchange and Foreign Trade Law by Keinan Shoji Co., Ltd., and Chung Yookija, a.k.a. Yukiko Kanazawa, the Ministry of Economy, Trade and Industry (METI) today implemented administrative sanction to ban exports under Article 53, Paragraph 2 of the Law. The action is summarized below.
1. Administrative sanction
Subjects of sanction: Keinan Shoji Co., Ltd., and Chung Yookija, a.k.a. Yukiko Kanazawa
Goods banned from export: All goods
Export ban regions: All regions
Export ban period: January 4, 2011, to June 3, 2011 (five months)
Note: Prohibited exports include those conducted via a third party.
2. Outline of the incident leading to sanctions
- Chung Yookija, a.k.a. Yukiko Kanazawa, director of Keinan Shoji Co., Ltd. (Shimonoseki-City, Yamaguchi), exported luxury goods (cosmetics) from Japan in May 2009, intending to export them to North Korea via Dalian, without obtaining approval from the METI Minister, which is required for exports destined for North Korea.
Note: The export of luxury goods to North Korea has been banned since November 15, 2006, under the Foreign Exchange and Foreign Trade Law in accordance with a U.N. Security Council resolution. - Additionally, although the export of items destined for North Korea is completely banned under the Foreign Exchange and Foreign Trade Law, Chung Yookija, a.k.a. Yukiko Kanazawa, exported food and daily necessities to Dalian, China, twice since August 2009, with the intention to export them to North Korea via Dalian without obtaining approval from the METI Minister.
Note: Since June 18, 2009, the export of all items destined for North Korea has been banned as part of Japan’s unilateral sanctions implemented under the Foreign Exchange and Foreign Trade Law.
