A Report Was Compiled Concerning the Results of the Investigation on the Imposition of Anti-dumping Duty on Toluenediisocyanate Originating in the People’s Republic of China

Regarding imposition of anti-dumping duty on toluenediisocyanate *1 originating in the People’s Republic of China*2, the Ministry of Economy, Trade and Industry (METI) and the Ministry of Finance (MOF) compiled the results of the investigation to confirm the fact that dumped products were imported to Japan and that the imports caused material injury to domestic industry. Consequently, on April 7, 2015, the Subcommittee on Trade Remedies under the Trade Committee of the Industrial Structure Council examined the appropriateness of the imposition of an anti-dumping duty.

On the same day, the Council on Customs, Tariff, Foreign Exchange and other Transactions under the Ministry of Finance recommended to the ministries that, concerning this case, the imposition of an anti-dumping duty for five years would be appropriate. The Government of Japan is to revise a part of the Cabinet Order concerning the imposition of provisional anti-dumping duties on toluenediisocyanate to incorporate the confirmed measures in due course.

1. Background

METI and MOF received an “Application for the Imposition of an Anti-dumping Duty on Toluenediisocyanate Originating in China” from Mitsui Chemicals, Inc. on December 17, 2013. In response, both ministries have jointly conducted an investigation since February 14, 2014, to determine whether or not to impose an anti-dumping duty.

On December 4, 2014, the ministries made a preliminary determination that presumes that dumped products were imported and that such imports caused actual damages to domestic industry. Since December 25, 2014, provisional anti-dumping duties under the Customs Tariff Act at a rate of 69.4% have been imposed on toluenediisocyanate originating in China (provisional measures).

*1: Toluenediisocyanate is a transparent liquid, mainly used as a raw material for flexible polyurethane foams, which are used in car seats, bedding, and other articles.
**2: Hong Kong and Macau special administrative regions are excluded.

2. Outline of the results of the investigation

METI and MOF concluded that the imposition of an anti-dumping duty was appropriate and compiled the results of the investigation into a report regarding toluenediisocyanate originating in China. Both ministries confirmed the fact that dumped products were imported and that the imports caused actual damages to domestic industry, which were unlikely to be corrected after the completion of the investigation, and accepted the necessity of imposing the duty in order to protect domestic industry from unfair trade.

On April 7, 2015, the Subcommittee on Trade Remedies under the Trade Committee of the Industrial Structure Council held a meeting and, in light of the report concerning the results of the investigation, the Council examined the appropriateness of the imposition of an anti-dumping duty. In addition, the Council on Customs, Tariff, Foreign Exchange and other Transactions under the Ministry of Finance held a meeting on the same day, and the Council recommended to the minister of finance that the imposition of an anti-dumping duty for five years on toluenediisocyanate originating in China would be appropriate.

3. Future schedule

The Government of Japan is to revise a part of the Cabinet Order for imposition of provisional anti-dumping duties on toluenediisocyanate to take the confirmed measures.
