The Ministry of Economy, Trade and Industry (METI) and the Ministry of Finance (MOF) have conducted an anti-dumping investigation on potassium hydroxide* originating in the Republic of Korea and the People’s Republic of China. On March 25, 2016, the Ministries made a preliminary determination that there is dumping and consequent injury to the domestic industry.

1. Background

METI and the MOF received a written application for the imposition of an anti-dumping duty on potassium hydroxide originating in the Republic of Korea and the People’s Republic of China from the Potassium Product Manufacturers Association on April 3, 2015. In response to this, both Ministries have been jointly conducting an investigation since May 26, 2015, to determine whether or not that there is dumping and consequent injury to the domestic industry.

*Note: Potassium hydroxide, a white flaky solid or dissolved in water as a liquid product, is mainly used as a raw material in the manufacture of potassium salts such as potassium carbonate, as a raw material in the manufacture of chemical fertilizer, in electrolytic solutions in alkaline batteries, in photographic developer, as a reaction auxiliary in inorganic chemistry, and as a raw material in the manufacture of liquid soap and detergent.

2. Outline of the investigation

During the investigation, the Ministries sent out questionnaires to the requested that interested parties asking for information relating to the exports, production, sales and imports of potassium hydroxidesubmit evidence, provided them with opportunities to state their opinions, and collected objective evidence from suppliers and other entities related to the products in question in the Republic of Korea and the People’s Republic of China. On the basis of the information, collectedAs a result, the evidence led the ministries to presume that dumped products were being imported and that the imports caused material injury to the domestic industry. Therefore, the Ministries hereby announce that, on March 25, 2016, they made a preliminary determination on this matter (public notice on March 25, 2016).

3. Future schedule

The Ministries, in addition to providing interested parties who have been involved in the preliminary determination with opportunities to state their opinions, will continue to investigate the matter in accordance with the provisions of international rules under the WTO Agreements and related domestic laws. On the basis of the information collected, the Ministries will determine whether the imports of the dumped product have caused material injury to the domestic industry, and the government will make a decision on whether or not to impose an anti-dumping duty on the product in question.
