Regarding the imposition of anti-dumping duty on potassium hydroxide* originating in the Republic of Korea and the People’s Republic of China,** the Ministry of Economy, Trade and Industry (METI) and the Ministry of Finance (MOF) compiled the results of the investigation to confirm the fact that dumped products were imported to Japan and that the imports caused material injury to domestic industry. Consequently, on July 11, 2016, the Subcommittee on Trade Remedies under the Trade Committee of the Industrial Structure Council examined the appropriateness of the imposition of an anti-dumping duty. On the same day, the Council on Customs, Tariff, Foreign Exchange and other Transactions under the Ministry of Finance recommended to the ministries that, concerning this case, the imposition of an anti-dumping duty for five years would be appropriate.

The Government of Japan is to revise a part of the Cabinet Order concerning the imposition of provisional anti-dumping duties on potassium hydroxide to incorporate the confirmed measures in due course.

1. Background

METI and MOF received an “Application for the Imposition of an Anti-dumping Duty on Potassium Hydroxide Originating in the ROK and China” from the Potassium Product Manufacturers Association on April 3, 2015. In response, both ministries have jointly conducted an investigation since May 26, 2015, to determine whether or not to impose an anti-dumping duty on the subject product.

On March 25, 2016, the ministries made a preliminary determination that presumes that dumped products were imported and that such imports caused material injury to domestic industry. Since April 9, 2016, provisional anti-dumping duties under the Customs Tariff Act at rates of 49.5% as for those originating in the ROK and 73.7% as for those originating in China have been imposed (provisional measures).

*1: Potassium hydroxide, a white flaky solid or dissolved in water as a liquid product, is mainly used as a raw material in the manufacture of potassium salts such as potassium carbonate, as a raw material in the manufacture of chemical fertilizer, in electrolytic solutions in alkaline batteries, in photographic developer, as a reaction auxiliary in inorganic chemistry, and as a raw material in the manufacture of liquid soap and detergent.
**2: Hong Kong and Macau special administrative regions are excluded.

2. Outline

Investigating authorities of METI and MOF concluded that the imposition of an anti-dumping duty was appropriate and compiled the results of the investigation into a report regarding potassium hydroxide originating in the ROK and China, which explained that dumped products were imported and that thoseimports caused material injury to domestic industry.

On July 11, 2016, the Subcommittee on Trade Remedies under the Trade Committee of the Industrial Structure Council held a meeting and examined the results of the investigation. In addition, the Council on Customs, Tariff, Foreign Exchange and other Transactions under the Ministry of Finance held a meeting on the same day and recommended to the minister of finance that the imposition of anti-dumping duties for five years on potassium hydroxide originating in the ROK and China would be appropriate.

3. Future actions

The Government of Japan is to revise a part of the Cabinet Order concerning the imposition of provisional anti-dumping duties on potassium hydroxide to incorporate the confirmed measures in due course.
