The Ministry of Economy, Trade and Industry (METI) hereby announces that aiming to put into force the Act for Partial Revision of the Act on Rational Use and Appropriate Management of Fluorocarbons (Act No. 25 of 2019; hereinafter referred to as the “Revised Act”), which was established by the Diet at its 198th ordinary session, the Cabinet, on October 1, 2019, approved two cabinet orders: the Cabinet Order for Partial Revision of the Order for Enforcement of the Act on Rationalized Use and Proper Management of Fluorocarbons; and the Cabinet Order for Stipulating the Enforcement Date of the Act for Partial Revision of the Act on Rational Use and Appropriate Management of Fluorocarbons.

1. Outline of the Cabinet Order for Partial Revision of the Order for Enforcement of the Act on Rationalized Use and Proper Management of Fluorocarbons

(1) Developing and improving the provisions for the collection of reports and the on-site inspections

The Revised Act expands the coverage of target businesses subject to the collection of reports by municipal or prefectural governors to additionally include primary contractors for specific demolition work and persons undertaking collection and other business of Class I specified products as well as the coverage of targets subject to the on-site inspections to additionally include offices and places of business of the contractors and persons, buildings and other structures to be demolished, and other facilities. In line with this revision, the government of Japan decided to revise related provisions in order to stipulate approaches to conducting the collection of reports therefrom and the on-site inspections thereto.

(2) Expanding the coverage of target designated products

The Cabinet Order is to expand the coverage of target designated products under Article 2 (2) of the Revised Act to additionally include: stock solutions for rigid polyurethane foam that is formed on site, except those used in housing construction materials; heat insulation members using rigid polyurethane foam; and refrigeration equipment and freezing equipment.

2. Outline of the Cabinet Order for Stipulating the Enforcement Date of the Act for Partial Revision of the Act on Rationalized Use and Proper Management of Fluorocarbons

The Cabinet Order is to stipulate the enforcement date of the Revised Act as April 1, 2020.
