Joint Press Release with the Ministry of Internal Affairs and Communications

The Ministry of Internal Affairs and Communications (MIC) and the Ministry of Economy, Trade and Industry (METI) called for public comments from June 20 (Thur.) to July 4 (Thur.), 2019, on the draft version of the Report on Discussion Results of the Study Group for Ideal Approaches to a Certification Scheme Concerning Verification of the Proper Management of Organizations which Handle Personal Data, which was compiled by the Study Group for Ideal Approaches to a Certification Scheme Concerning Organizations which Handle Personal Data (hereinafter referred to as the “study group”; chair: Mr. George Shishido, Professor, Graduate Schools for Law and Politics, the University of Tokyo), and received 10 opinions as a result. MIC and METI hereby release these opinions submitted to MIC and METI, the ministries’ responses to these opinions, the report which includes these opinions and the second version of the guidelines.

1. Outline

MIC and METI jointly established the study group and, in June 2019, the study group compiled the Guidelines of Certification Schemes Concerning Verification of the Proper Management of Organizations which Handle Personal Data ver. 1.0 (hereinafter referred to as the “guidelines”), a compilation explaining systems operated by private, non-governmental associations and other organizations which certify the proper management of personal data trust banks. The guidelines aim to provide effective instruction on the operation of systems used by private, non-governmental associations and other organizations which certify personal data trust banks as trustworthy. They are prepared mainly focusing on data distribution originating from individual consumers and ensure reliability for consumers. The guidelines consist of: [i] certification criteria, [ii] example clauses and [iii] certification schemes, and based on these points, in December 2018, a certification association started accepting applications for certification.

Following this, in January 2019, the study group resumed discussions on points of contention, including revision of the guidelines, e.g., basic approaches to certification and roles played by the Data Ethics Examination Committee, concerning ideal approaches to certification schemes involving the proper management of personal data trust banks, taking into consideration changes in conditions surrounding personal data trust banks after the release of the guidelines, e.g., enhanced specifics of businesses as a result of demonstrations and other efforts and the start of certification programs under the guidelines. Regarding the Draft Report on Discussion Results of the Study Group for Ideal Approaches to a Certification Scheme Concerning Verification of the Proper Management of Organizations which Handle Personal Data, which was compiled by the study group, MIC and METI called for public comments from June 20 (Thur.) to July 4 (Thur.), 2019, and received 10 opinions as a result.

MIC and METI hereby release the opinions submitted to the ministries, the ministries’ responses to these opinions, and the Report on the Discussion Results of the Study Group for Ideal Approaches to a Certification Scheme Concerning Verification of the Proper Management of Organizations which Handle Personal Data, which includes these opinions, and the Guidelines for Certification Schemes Concerning Verification of the Proper Management of Organizations which Handle Personal Data ver. 2.0.
