Cabinet Decision on the Cabinet Order Regarding the Organization of Relevant Cabinet Orders and Transitional Measures Associated with the Coming into Effect of the Act on the Partial Revision of the Electricity Business Act and Other Acts for Establishing Resilient and Sustainable Electricity Supply Systems

Today, a Cabinet decision was made on the Cabinet Order Regarding the Organization of Relevant Cabinet Orders and Transitional Measure Associated with the Coming into Effect of the Act on the Partial Revision of the Electricity Business Act and Other Acts for Establishing Resilient and Sustainable Electricity Supply Systems.
This order was made in association with the coming into effect of (Article 1 of the Supplementary Provisions of) the Act on the Partial Revision of the Electricity Business Act and Other Acts for Establishing Resilient and Sustainable Electricity Supply Systems (hereinafter referred to as the "Amending Act"), which was enacted at the 201st Ordinary Session of the Diet. It organizes the Order for Enforcement of the Electricity Business Act and other relevant Cabinet Orders, and stipulates transitional measures regarding the criteria for the creation of a succession plan.

1. About the Amending Act

The Amending Act comes into effect on April 1, 2022. Its measures include newly establishing electricity distributors and specified wholesale suppliers toward expansion of distributed power systems, and creating a Feed-in-Premium (FIP) scheme (in which renewable energy generators are able to receive a certain level of premium on the market price) with the aim of maximizing renewable energy use and minimizing the public's burden at the same time.

2. Outline of the Cabinet order

This order is to organize the Order for Enforcement of the Electricity Business Act (Cabinet Order No. 206 of 1965) and other relevant Cabinet orders and stipulate transitional measures regarding the criteria for the creation of a succession plan in association with the coming into effect of the Article 1 of the Supplementary Provisions of the Amending Act.

Promulgated and partially coming into effect on: February 2, 2022 (Wed.)

Note: The transitional measures regarding the creation planning for a succession plan will come into effect as soon as the Act is promulgated because the succession plan must be prepared before the Act comes into effect.
Coming into effect on: April 1 (Fri.), 2022
