Cabinet Decisions Made on the “Cabinet Order for Stipulating the Enforcement Date of the Act of Partial Revision of the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies and the Act on the New Energy and Industrial Technology Development Organization,” and on the “Cabinet Order for the Partial Amendment of the Order for Enforcement of the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies, etc.”

1. Background and purpose

While digitalization has expanded the use of high-performance semiconductors in various fields (e.g., automobiles and medical devices), there is an increasing risk of geopolitical conditions affecting their global supply chains. Securing production capacity in Japan is an urgent issue from the perspectives of strengthening industrial infrastructure and ensuring the country remains strategically essential and strategically independent.
In light of these circumstances, the Japanese government will take measures to facilitate businesses' decisions to invest in the development and production of high-performance semiconductor production facilities etc. and contribute to securing stable production in the country. These measures include: establishing a certification program for plans concerning development and production of high-performance semiconductor production facilities etc.; providing grants to finance the execution of the certified plans; and establishing a fund for the grants etc. Enacted in the 207th Session of the Diet (extraordinary session), the “Act of Partial Revision of the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies and the Act on the New Energy and Industrial Technology Development Organization” stipulate putting these measures into effect.
Today's Cabinet orders establish the date this act will come into effect and, along with this act coming into effect, partially amends the Order for Enforcement of the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies, etc., stipulates specified semiconductor types and their respective technologies, and establishes necessary provisions.

2. Outline of the Cabinet order

(1) Cabinet Order for Stipulating the Enforcement Date of Act on Partially Amending the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies and the Act on the New Energy and Industrial Technology Development Organization

March 1, 2022, has been set as the enforcement date for the Act on Partially Amending the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies and the Act on the New Energy and Industrial Technology Development Organization.

(2) Cabinet Order for the Partial Amendment of the Order for Enforcement of the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies, etc.

(i) Partial amendment to the Order for Enforcement of the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies

• Specified semiconductor types and their respective technologies will be stipulated in accordance with the provisions of Article 2 (4) of the Act on Promotion of Developing/Supplying and Introducing Systems Making Use of Specified Advanced Information Communication Technologies.

(ii) Partial amendment to the Order for Enforcement of the Act on the New Energy and Industrial Technology Development Organization

• Procedures will be stipulated for the payments prescribed in the provisions of Article 16-4 (5) of the Act on the New Energy and Industrial Technology Development Organization, etc.

Promulgation date: February 28, 2022 (Mon.)
Enforcement date: March 1, 2022 (Tue.)
