Interim Report of the Subcommittee on Security Export Control Policy under the Trade Committee of the Industrial Structure Council

Considering the changes in the international security environment, the Subcommittee on Security Export Control Policy under the Trade Committee of the Industrial Structure Council resumed a series of meetings from November 2023 in order to discuss ways to review current security export control systems. Following the discussion, the Subcommittee published an interim report.

1. Overview

Based on a recognition of the current security environment, including the re-emergence of state actors as security interests and the growing importance of dual-use technologies, the interim report points out that the traditional framework of nonproliferation export control has reached a turning point.

The report recommends that Japan should explore new approaches to items other than sensitive items with particularly high potential for diversion to military use (items falling under what is called the “list control”) and should advance efforts to achieve effective security export control. In particular, it proposes that Japan should review related systems and operations regarding the following points.

  1. Review the complementary approach to the list control to address the growing potential for diversion to military use of dual-use items and technologies
  2. Establish a new dialogue framework on technology transfer between public and private sectors by taking advantage of some mechanisms under the Foreign Exchange and Foreign Trade Act, amid the growing importance of technology transfer control
  3. Explore multilayered international collaboration for agile and effective export control
  4. Streamline and prioritize export control systems and implementations in accordance with the respective levels of security concerns, etc.

As underlying challenges, the interim report also proposes that Japan should secure further transparency of security export control for domestic and overseas stakeholders, improve its intelligence capacity, and utilize external human resources.
