Cabinet Decision on the Cabinet Order to Partially Amend the Foreign Exchange Order

For the purposes of preventing the proliferation of weapons of mass destruction, preventing the excess accumulation of conventional weapons, and executing treaties and other international agreements, the Ministry of Economy, Trade and Industry (METI) controls exports of goods and technologies under the Foreign Exchange and Foreign Trade Act, and under the Foreign Exchange Order (hereinafter referred to as the “Exchange Order”) and the Export Trade Control Order (hereinafter referred to as the “Export Order”) pursuant to the Foreign Exchange and Foreign Trade Act.
On April 4, 2025, a Cabinet Decision was made on the Bill of the Cabinet Order to Partially Amend the Foreign Exchange Order. concerning the review of complementary export control.

Outline of the revision

In view of the proposals in the interim report of the Subcommittee on Security Export Control Policy under the Trade Committee of the Industrial Structure Council, METI (April 24, 2024), amendments were made and will be reflected in Japan’s domestic systems.

Specific details of the revision are as follows.

Review of complementary export control on conventional weapons for general countries

Exports and so forth of specific non-listed items and technologies that are likely to be used for the development or suchlike of conventional weapons will require a license issued by the Minister of Economy, Trade and Industry.

Preventing circumvention via Group A countries

Exports and so forth of goods or technologies destined for countries/regions indicated in the Appended Table 3 of the Export Order will require an export license issued by the Minister of Economy, Trade and Industry, if notified as requiring an application for such a license due to the risk of being used for the development and suchlike of weapons of mass destruction and so forth or conventional weapons. This is primarily from the perspective of preventing circumvention to regions other than such countries/regions.

Exemption of application for licenses for taking back defense equipment by the armed forces of like-minded countries

Exports of goods brought into Japan by the armed forces of like-minded countries for the purpose of joint training with the Self-Defense Forces will be exceptions to export license requirements.
