Guidance for the Control of Sensitive Technologies for Security Export (for Academic and Research Institutions) Amended

The Ministry of Economy, Trade and Industry (METI) has published guidance streamlining what academic institutions should do to comply with the Foreign Exchange and Foreign Trade Act (Act No. 228 of 1949, hereinafter, FEFTA), with the aim of encouraging the establishment of an effective compliance framework and enhancing the control of sensitive technologies. In light of the system revision, including the review of complementary export control pursuant to FEFTA, which will come into effect on Thursday, October 9, 2025, METI amended the guidance to support academic and research institutions in taking appropriate measures with consideration to the system revision.

1. Background

Under the common recognition that effective export control is also necessary for academic and research institutions engaging in state-of-the-art R&D efforts, METI works with the Ministry of Education, Culture, Sports, Science and Technology (MEXT) and other organizations to hold briefing sessions, dispatch experts, and develop and publish the Guidance for the Control of Sensitive Technologies for Security Export (for Academic and Research Institutions), thereby raising awareness and supporting them in building internal control systems.

In recent years, amid changes in the security environment such as the growing importance of dual-use technologies and the rise of technology-possessing countries that are not members of multilateral export control regimes, it has become increasingly important to strengthen the control of sensitive technologies at universities and other institutions. Under FEFTA, in order to address the increasing possibility of the diversion of general-purpose technologies and products to military use, government ordinances and ministerial orders have been revised to review complementary export controls (which will come into effect on Thursday, October 9, 2025).

Today, METI amended the Guidance for the Control of Sensitive Technologies for Security Export (for Academic and Research Institutions) to support universities and other institutions in appropriately responding to the system revision.

2. Key points of the revised guidance

Today's amendment includes changes to the outline of complementary export control in light of the system revision and changes to the entry items to be included in ledgers and forms shown as reference. In addition, a new system outline for the public-private dialogue scheme, which was established in 2024, is added.

3. Future directions

Going forward, based on the amended guidance, METI will hold explanatory meetings for academic and research institutions to widely publicize the system revision. METI will also continue to review the system constantly, taking into account the situation regarding security trade control and the efforts being made by universities and other institutions for security trade control.
