Announcement of the names of companies that have voluntarily established Internal Compliance Programs (ICPs) and registered them with METI

1. Since Oct. 31, 2003, METI has been publishing on its Web site the names of companies that have voluntarily established ICPs, conducted self-audits, and registered with METI for the purpose of implementing appropriate security export controls in compliance with the METI notice regarding “Establishment or revision of internal compliance programs to ensure compliance with export control laws and regulations corresponding to export controls aimed at non-proliferation” (24 June 1994/No.604).

2. For a number of years, METI has been encouraging exporters to establish and revise ICPs, but after implementation of catch-all controls on weapons of mass destructions in April 2002, the number of items subject to export controls vastly increased. Most companies are now required to confirm both the end-user and end-use of their exports, which makes self-control by each company more important. In addition, the METI notice regarding “Detouring exports of items related to weapons of mass destruction” (26 May 2003) also asks export-related companies to strengthen internal export control compliance taking actions such as (a) strengthening internal export control systems by carefully checking end-users and end-uses, bearing detouring of exports in mind, and (b) implementing internal reviews equivalent to those conducted under the self-governing export-control system when it is clear that even though items are sold in Japan, they will be subsequently exported. In this context, METI hopes to promote effective export controls in each company by publicizing the names of companies that have established ICPs.

3. Please note that publication of company names is performed based on companies’ voluntary establishment of ICPs, self-audits, and registration with METI, and does not confer any legal status or take the place of judgments by the Security Export Control Inspection Office. METI would like to make it clear that it does not provide preferential treatment in the application of export control laws and related regulations based on the fact that a company is published on its Web site.

4. As a rule, companies will have their names listed on the site for one year, subject to annual renewal. Names of new companies are added quarterly.
