Circular Notice on Partial Amendment to the Circular Notice on the Operation of the Cabinet Order on Export Trade Control and other circular notices (Review of Export Control to South Korea)

The Ministry of Economy, Trade and Industry (METI) has decided to review the operation of the exports of three items to the Republic of Korea based on the Foreign Exchange and Foreign Trade Act.
1. Background and outline
The following operation reviews will be implemented for the export of three products to the Republic of Korea based on the Foreign Exchange and Foreign Trade Act.
In accordance with this revision, the three items will be included in the Special General Bulk Export License system.
Business entities exporting or providing technology to the ROK are asked to continue to comply with laws and regulations related to the Foreign Exchange and Foreign Trade Act and conduct strict transaction inspections, including confirmations of the end-users and applications, in accordance with their internal regulations for export control.
2. Details of the revision
(1) Addition of specific items to the scope of the Special General Bulk Export License system
The export of hydrogen fluoride, fluorinated polyimide, and resists and the transfer of their related technologies to the ROK will be included in the Special General Bulk Export License system.
<Sections concerning the three items in the appended tables of the Export Order and Ordinance on Goods>
○ Hydrogen fluoride: Row 3 (i) of Appended Table 1 of the Export Order, and Article 2, Paragraph (1), Item (i)(f) of the Ordinance on Goods
○ Fluorinated polyimide: Row 5 (xvii) of Appended Table 1 of the Export Order, and Article 4, Item (xiv)(b) of the Ordinance on Goods
○ Resists: Row 7 (xix) of Appended Table 1 of the Export Order, and Article 6, Item (xix) of the Ordinance on Goods
(2) Change of point of contact for applications for specified items
The point of contact for applications for export licenses to the ROK for the three items above will be changed from the Trade Security Inspection Division, Trade and Economic Cooperation Bureau, METI, to METI bureaus and trade offices.
3. Schedule
Effective as of March 23 (Thu.), 2023.
