Cabinet Decision on the Cabinet Order to Partially Amend the Export Trade Control Order

A Cabinet Decision was made on June 27, 2023, on the Cabinet Order to Partially Amend the Export Trade Control Order (hereinafter referred to as the "Export Order”) under the Foreign Exchange and Foreign Trade Act (hereinafter referred to as “FEFTA”). The decision concerned the addition of the Republic of Korea (ROK) to the list of the countries in Appended Table 3 of the Export Order.
1. Outline
- Addition of the ROK to the list of the countries in Appended Table 3 of the Export Order
- Revision of related notices, including the Guidelines for Permission of Bulk Licenses, in line with the revision of the Export Order
- Allowance of application of a general bulk license to exports destined for the ROK and removal of the exports from the coverage of the catch-all control* in line with the revision above
*Note: Under this system, if an exporter intends to export any goods not in the export regulatory list but the goods could be used for the development, manufacture, use, or storage of weapons of mass destruction or conventional weapons, the exporter is required to file an application for an export license.
2. Details of the revision
(1) Revision related to the Export Order
- Addition of the ROK to the list of the countries in Appended Table 3 of the Export Order
(2) Revision related to the Guidelines for Permission of Bulk Licenses
- Allowance of application of a general bulk license to exports of goods destined for the ROK and provision of technologies thereto
Note: For details of the revision of related notices, see the documents scheduled to be released on June 30, 2023.
3. Points to note
- Those intending to export goods or provide technologies to the ROK should continue to comply with laws and regulations related FEFTA, and also make sure to strictly conduct transaction screening, including careful verification of end-users and purpose of use, under internal rules for export control, etc.

Enforcement: July 21 (Fri.), 2023
